Terms of Participation & Liability Waiver

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE REGISTERING FOR ANY LEAGUE. BY CHECKING THE ACKNOWLEDGMENT BOX DURING REGISTRATION, YOU AGREE TO BE LEGALLY BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT AGREE, DO NOT REGISTER.
These Terms of Participation and Liability Waiver (the "Agreement") are entered into between you ("Participant") and RacketLeague NYC ("Company," "we," "us," or "our"), a recreational sports league organizer operating in New York City and surrounding areas. This Agreement governs your participation in any tennis, pickleball, or other racket sport league, event, or activity organized or facilitated by the Company (collectively, "League Activities").
1. Nature of the Activity & Inherent Risks
Participation in tennis, pickleball, and similar racket sports involves inherent risks of physical injury, including but not limited to: sprains, strains, fractures, torn ligaments and tendons, concussions, eye injuries, cardiovascular events, heat-related illness, and death. These risks exist regardless of the precautions taken by the Company, courts, facilities, or other participants.
Additional risks include, without limitation: contact with other players, equipment (rackets, balls, nets, court fixtures), spectators, or bystanders; slippery or uneven court surfaces; inadequate or absent lighting; equipment failure; defective or improperly maintained facilities; acts or omissions of other participants; and risks associated with travel to and from League Activities.
You acknowledge that you are aware of, understand, and voluntarily accept all such inherent and non-inherent risks associated with League Activities as a condition of participation.
2. Voluntary Assumption of Risk
By registering for any League Activity, you expressly acknowledge that: (a) you have read and understand the risks described herein; (b) your participation is entirely voluntary; (c) you have had the opportunity to consult with a physician regarding your physical fitness and suitability to participate; and (d) you assume all risks of injury, property damage, or death arising out of or related to your participation in League Activities, whether or not such risks are described in this Agreement.
This assumption of risk includes, but is not limited to, risks arising from the conduct of other participants, league organizers, court operators, and any other person present at League Activities.
3. Release & Waiver of Claims
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU, ON BEHALF OF YOURSELF, YOUR HEIRS, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND NEXT OF KIN, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Company, its owners, officers, directors, employees, contractors, volunteers, agents, successors, and assigns (collectively, "Released Parties") from any and all claims, demands, losses, damages, injuries, costs, and expenses of any nature whatsoever - including claims for personal injury, property damage, wrongful death, or any other loss - arising out of or in connection with your participation in League Activities, whether caused by the negligence of the Released Parties or otherwise, except to the extent such claims arise from the gross negligence or willful misconduct of the Released Parties.
This release specifically includes, without limitation, claims arising from:
- Physical contact or altercations with other participants;
- Acts, omissions, or conduct of other participants whom you may have met, been introduced to, or been matched with through the Company or its platform;
- Defects or conditions of the courts or facilities used for League Activities;
- Equipment failure or misuse;
- Scheduling errors, cancellations, or disputes;
- Any medical condition exacerbated by participation.
4. Third-Party Conduct
The Company acts solely as an organizer that facilitates match scheduling and league administration. The Company does not supervise, control, or assume responsibility for the actions, conduct, character, or behavior of individual participants during or outside of League Activities. You acknowledge that the Company does not conduct background checks on participants and that your interactions with other participants - including any injury, harm, harassment, or damage caused by another participant to you, whether during League Activities or otherwise - are not the responsibility of the Company.
By sharing your contact information with other participants in a given league (as required for match scheduling), you do so voluntarily and accept all risks associated with such disclosure, including risks arising from how other participants may use that information or behave toward you.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN LEAGUE ACTIVITIES OR USE OF THE COMPANY'S PLATFORM OR SERVICES.
NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT, THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM OR SERIES OF RELATED CLAIMS ARISING OUT OF OR RELATED TO LEAGUE ACTIVITIES OR THIS AGREEMENT SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100.00), REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM, WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE.
Note: Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such limitations are prohibited by applicable law, they shall apply to the maximum extent permitted.
6. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from: (a) your participation in League Activities; (b) your violation of this Agreement; (c) your violation of any applicable law or regulation; or (d) any injury or damage you cause to another participant, third party, or property.
7. Health, Fitness & Medical Condition
You represent and warrant that you are in adequate physical condition to safely participate in racket sport activities, that you have no medical condition that would make such participation inadvisable, and that you have consulted with or had the opportunity to consult with a licensed physician before registering. You agree to immediately discontinue participation if you experience any pain, discomfort, or medical symptoms during League Activities.
The Company is not responsible for obtaining or maintaining medical personnel, first aid equipment, or emergency services at any venue used for League Activities. Emergency response, if needed, is the sole responsibility of the venue operator and/or the participant.
8. Rules of Conduct
Participants agree to conduct themselves in a respectful and sportsmanlike manner at all times during League Activities. The Company reserves the right, in its sole discretion, to remove any participant from a league without refund for conduct deemed unsafe, disrespectful, abusive, or otherwise disruptive. Such removal does not limit any claims the Company may have against the removed participant.
9. Dispute Resolution & Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Any dispute arising out of or relating to this Agreement or your participation in League Activities that cannot be resolved informally shall be submitted to binding arbitration in New York County, New York, administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. Judgment on any arbitration award may be entered in any court of competent jurisdiction. You agree that any dispute will be resolved on an individual basis and not as a class or collective action.
To the extent arbitration is found unenforceable, any litigation shall be brought exclusively in the state or federal courts located in New York County, New York, and you hereby consent to personal jurisdiction in such courts.
10. Severability & Entire Agreement
If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law - including under New York General Obligations Law §5-326 or any other statute - that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from this Agreement. The remaining provisions shall continue in full force and effect.
This Agreement constitutes the entire agreement between you and the Company with respect to your participation in League Activities and supersedes all prior discussions, representations, or agreements relating to the same subject matter.
11. Privacy Notice
RacketLeague NYC is committed to protecting your personal information. This Privacy Notice explains what data we collect, why we collect it, how it is used, and with whom it is shared. By registering for a League Activity or using our platform, you consent to the practices described below.
What We Collect
- Account information: your name and email address, provided via Google Sign-In during account creation.
- Profile information: phone number, contact email, home court preference, and self-assessed skill ratings (e.g., NTRP, UTR, DUPR) that you enter voluntarily.
- Registration & payment data: league registrations, partner preferences, referral codes, and payment details. Payment transactions are processed securely by Stripe; we do not store full payment card information on our servers.
- Match & activity data: match scores, win/loss records, and any disputes you file through the platform.
- Usage & analytics data: anonymized browsing and interaction data collected via Google Analytics and Meta Pixel to help us understand how the platform is used and improve our services.
Why We Collect It
- To create and manage your account and league registrations.
- To match you with appropriate leagues based on your skill level.
- To facilitate match scheduling by sharing contact information with your league partners.
- To process payments and issue refunds when applicable.
- To communicate with you about your league, upcoming seasons, and platform updates.
- To analyze platform usage and improve our services.
How It Is Used & With Whom It Is Shared
- Other league participants: your name and contact email are shared with other players in your league solely for match scheduling purposes.
- Stripe: your payment information is transmitted to and processed by Stripe, Inc. in accordance with their privacy policy.
- Google Analytics & Meta Pixel: anonymized usage data is shared with Google LLC and Meta Platforms, Inc. to support analytics and marketing. No personally identifiable information is shared with these providers beyond what is standard to their tracking technologies.
- Supabase: your data is stored in a PostgreSQL database hosted by Supabase, Inc. on servers in the United States.
- We do not sell your personal information to third parties.
Your Rights
You may request access to, correction of, or deletion of your personal data at any time by contacting us at racketleague@outlook.com. We will respond to verifiable requests within a reasonable timeframe. Note that deletion of your account data may prevent you from participating in future leagues.
By using this platform and registering for a League Activity, you acknowledge that you have read this Privacy Notice and consent to the collection and use of your data as described herein.
12. RacketLeague Reserved Rights
In addition to the rights described elsewhere in this Agreement, RacketLeague NYC expressly reserves the following rights, which it may exercise in its sole and reasonable discretion:
- League & Season Adjustments: The Company reserves the right to move, reassign, or transfer registered participants between leagues, seasons, or skill divisions as necessary to optimize capacity, ensure competitive balance, or address operational needs. In such cases, the Company will make reasonable efforts to notify affected participants in advance and to place them in a comparable league.
- Refunds for Under-Capacity Leagues: If a league does not reach minimum enrollment capacity, the Company reserves the right to cancel that league and issue a full refund to all registered participants. The Company will notify affected participants promptly and, where possible, offer placement in an alternative league.
- Suspension of Access: The Company reserves the right to temporarily suspend a participant's access to the platform, league scheduling, or play if that participant receives credible complaints from other participants. Any suspension will be subject to a good-faith review, and the participant will be notified of the suspension and given an opportunity to respond.
- Account Cancellation: The Company reserves the right to permanently cancel the account of any participant who is reasonably suspected of acting maliciously — including but not limited to fraud, harassment, abuse of the platform, or conduct that endangers other participants. Permanently cancelled accounts may forfeit any remaining credits or registrations without refund, subject to applicable law.
Exercise of any of the above rights does not limit any other remedies available to the Company under this Agreement or applicable law.
13. Acknowledgment
BY CHECKING THE ACKNOWLEDGMENT BOX DURING REGISTRATION, YOU CONFIRM THAT:
- You have read this entire Agreement — including the Privacy Notice in Section 11 — and understand its contents;
- You are at least 18 years of age, or have obtained the written consent of a parent or guardian;
- You are signing this Agreement freely and voluntarily, without coercion;
- You understand that this Agreement limits your legal rights, including your right to sue the Company and Released Parties for injuries, death, or other losses;
- You agree to be bound by all terms set forth above.
